Aggravated DWI

A customer was refused a sale of alcohol at a Speedway store near 409 Hwy. 566 due to intoxication. The male then left the store in a white Chevrolet pickup truck and headed south on the highway. The incident was reported to Metro Dispatch, who issued an attempt-to-locate on the truck.

McKinley County Sheriff’s Deputy Frank Villa arrived near the intersection of Highway 118 and Highway 566 and parked to see if the vehicle was nearby. Several minutes later a truck matching the description of the ATL vehicle passed going south on Highway 566 and Villa turned to follow it.

Villa pulled the suspect vehicle over near the 29 mile marker of Highway 118 and conducted a traffic stop. He met the driver, Jacob Tolth, 30, no address listed, showed  including bloodshot eyes and slurred speech.

Tolth said he consumed “not enough” alcohol prior to driving and was coming from his job in Crownpoint to Gallup. His answers were unclear and he did not know all of the details of where he was going. He agreed to take the Standard Field Sobriety Tests, but was stopped after Villa saw that  he could not maintain his balance during one test.

After being placed under arrest, Tolth refused to give a breath sample. He was transported to McKinley County Adult Detention Center and booked for aggravated DWI.

Aggravated DWI

A call came into Metro Dispatch from the Speedway store in Thoreau after an employee saw two males who appeared intoxicated in the front seat of a blue passenger car. Several other persons who were also intoxicated staggered towards the store from the vehicle as well. The vehicle left the scene at a high speed and nearly collided with a semi-truck as it traveled towards I-40.

McKinley County Sheriff’s Deputy Terence Willie was near the intersection of Highway 122 and Highway 371 when he saw a vehicle matching the description approach him. The vehicle turned onto I-40 and headed west and Willie turned to follow it.

Willie found the vehicle, a blue Ford Fiesta, pulled to the side of the interstate near the 47.5 mile marker and two males exited from the front seats. Willie observed the driver, Jones Begay, 54, no address listed, showing signs of intoxication including bloodshot eyes, a smell of alcohol on his person, and he staggered as he walked towards him. The passenger appeared intoxicated, and he was also detained.

Begay told Willie they were traveling from Thoreau to Gallup and admitted consuming three 12-oz. cans of Coors Light about an hour prior to driving. He tried to contact his sister at the scene but there was no response. Begay also refused to take the Standard Field Sobriety Tests.

After being placed under arrest, Begay did agree to give a breath sample. He was transported to the sheriff’s office for the test, where he posted two samples of .24. Begay was then taken to McKinley County Adult Detention Center and booked for aggravated DWI, duration of evidence, having an open container in a vehicle, and having no license, registration, or insurance.
