Aggravated DWI
A Tohatchi man was stopped for speeding and driving recklessly at a local gas station, where he was eventually arrested and charged with DWI.
McKinley County Sheriff’s Deputy Aaron Marquez responded to a call for service on U.S. Highway 491. The calling party stated they were following a red Chevrolet Avalanche that was swerving in and out of traffic southbound on the highway. The vehicle was also reportedly missing its left rearview window.
Marquez traveled towards Yatahey where he was advised that the suspect vehicle was driving southbound and then turning back northbound. He arrived near the Edward O Plummer Interchange and found a vehicle matching the description. It traveled northbound, continuing to swerve in and out of lanes and the shoulder of traffic. The vehicle finally stopped at the Tohlaakai Speedway on U.S. Highway 491, where Marquez caught up and conducted a traffic stop.
The driver, Randell David, 33, exited the vehicle on command but reportedly had trouble keeping his balance. David also appeared to be confused as Marquez spoke and allegedly said he did not understand his rights. He also showed symptoms of intoxication including slurred speech, bloodshot eyes, and smelling of alcohol.
David stated he did not do anything wrong and gave no verbal consent to Marquez, who then placed him under arrest for his refusal. A search of David’s vehicle showed open containers of Coors Light and Importers Vodka. He agreed to give a breath sample and was transported to the sheriff’s office for the test, where he posted samples of .28, .25, and .27.
He was then taken to McKinley County Adult Detention Center and booked for aggravated DWI, resisting, evading, or obstructing an officer, failure to maintain lane, and open container. His pretrial hearing is set for Nov. 5.
